Il contratto stipulato tra la E.PowerSystems Srl ed il Cliente deve intendersi concluso con l’accettazione, anche solo parziale, dell’ordine da parte della E.PowerSystems Srl. E.PowerSystems Srl provvederà a recapitare ai clienti i prodotti selezionati ed ordinati, con le modalità di cui al precedente articolo, mediante corrieri e/o spedizionieri di fiducia. In caso di assenza del destinatario al momento della consegna verrà lasciato un avviso ed il cliente dovrà provvedere personalmente a contattare nel più breve tempo possibile il corriere o spedizioniere onde concordare le modalità di consegna.

E.PowerSystems Srl non assume alcuna responsabilità per i disservizi imputabili a causa di forza maggiore quali incidenti, esplosioni, incendi, scioperi e/o serrate, terremoti, alluvioni ed altri similari eventi che impedissero, in tutto o in parte, di dare esecuzione nei tempi concordati al contratto.
E.PowerSystems Srl non sarà responsabile nei confronti di alcuna parte in merito a danni, perdite e costi subiti a seguito della mancata esecuzione del contratto per le cause sopra citate, avendo il consumatore diritto soltanto alla restituzione del prezzo corrisposto.

E.PowerSystems Srl accorda una garanzia di mesi 60 dalla data d’acquisto. La normativa di riferimento e le modalità di applicazione della garanzia sono quelle evidenziate nel certificato di garanzia sempre allegato al prodotto e qui sintetizzate.

Right of withdrawal.

Le spese di restituzione saranno a carico del cliente. Una volta ricevuta la merce e verificatane l’integrità E.PowerSystems Srl provvederà, nel più breve tempo possibile, ad accreditare al cliente a mezzo bonifico bancario il costo dei prodotti restituiti, trattenendo l’importo delle spese di spedizione sostenute per il primo invio della merce, che resteranno comunque a carico del cliente, e le eventuali spese di ripristino per danni accertati alla merce. Sarà cura del cliente fornire tempestivamente le coordinate bancarie sulle quali ottenere il bonifico (codice IBAN).
Contract resolution and express termination clause.
E.PowerSystems Srl ha la facoltà di risolvere il contratto stipulato dandone semplice comunicazione al cliente con adeguate e giustificate motivazioni; in tal caso il cliente avrà diritto esclusivamente alla restituzione dell’eventuale somma già corrisposta.
Le obbligazioni assunte dal cliente di cui all’Art. “Obblighi dell’acquirente” , nonché la garanzia del buon fine del pagamento che il cliente effettua con i mezzi di cui all’Art. “Modalità di pagamento accettate”, hanno carattere essenziale, cosicché per patto espresso, la inadempienza, da parte del Cliente, di una soltanto di dette obbligazioni determinerà la risoluzione di diritto del contratto ex Art.1456 c.c., senza necessità di pronuncia giudiziale, fatto salvo il diritto per la E.PowerSystems Srl di agire in giudizio per il risarcimento dell’ulteriore danno. Il cliente ha facoltà di annullare il contratto entro 24 ore dal ricevimento della conferma dandone tempestiva comunicazione al servizio clienti via mail a sales@epowersystems.it
Jurisdiction and competent court.
